Can I recoup  any costs from a paternity test

I just got back a negative result on a paternity test that I
requested, do I have any rights?   I'm in Pennsylvania.

Here's the time line .. I have text messages and emails which verify
all of this from the mother

oct 06 - got a call that my ex was pregnant and me and someone else
could be the dads.. I am most likely given the dates (I know not
reliable)

Dec- May 07 - many emails and txt's exchanged trying to prepare. She
constantly notes how she hopes I am the father.  I'm just trying to
step and do what's right.  She can't take a test since she is a high
risk pregnancy.  Promises me we can take the test once the baby is
born. All plans are contingent on that.

May 07 - She cuts off all contact.  I make a few attempts to reach
her, but am afraid of getting an order of protection or something like
it.  I back off and leave messages asking her to let me be at hospital
when child is born

June 07 - She finally responds and tells me the baby was born 10 days
ago.  A test was already complete and I am not the father.  I ask her
to fax me the report for my records

24 hours later-  she writes me a long email telling me she lied and
never took a test.  She schedules a test immediately and I go and give
DNA
One week later - she has cut contact again and never gave DNA.  I hire
a lawyer..
July to august - 2 lawyers and finally a mediator is involved.  They
are ready to get a court order for the test based on the emails I
have. The day before she is to be served she finally gives DNA.  I pay
$400 for half the test.
There were also some angry calls from her father (she is 29)  to me
telling me to go away etc...  I inform him he should get a lawyer..

Today -  I got the test and its negative.

I'm over $4000 in the hole for this and did it because she told me I
was the most likely father. I have no issue with that, but once they
cut me off I was forced to get an attorney and pay court costs for a
test that I am told I was legally entitled to.

Do I have any recourse at all?  My current lawyer doesn't handle these
kind of cases and says its not worth it, but he got paid already so I
guess its not for him..

You could try small claims court, but it's a long shot.  If she said
you are "most likely" the father of the child, then she can claim that
it was a simple mistake and there was no intent to defraud you.

Consider yourself lucky -- you are out only $4000 and underwent some
emotional stress that you shouldn't have had to endure.  But you
successfully used the system to avoid becoming a victim of paternity
fraud, and of paying 18+ years of child support for somebody else's
child.  Step up one more time and urge this woman to notify the real
father that he has a child now who needs him.  It's not really your
job, but obviously this woman can't be depended on to do the right
thing.  Tell your future sons and all the men you know about your
experience so they can protect themselves by demanding the test just
like you did.

It's clear he hasn't got a prayer of winning a paternity fraud case,
but that doesn't mean he can't get some of his money back in small
claims court.  The thing here is not so much the paternity test, but
the cutting off of communication that led to the legal fees.  He may
indeed be able to get some of those legal fees back, especially having
evidence that she led him to believe he was the father and then
obstructed his ability to find out for certain.  Whatever he spent
from June 7 onwards ought to be fair game for a civil suit.

So this tramp gets laid by multiple partners and everyone has to scramble
when the honorable woman becomes a mother with child.

Yes, but their has to be consequences for such reckless actions that some
women cause by naming innocent men as the father of their bastard child.
This practice needs to stop!

No, I agree with you 100%...that's why I first said "SUE HER!!!"...
Just telling him that he's a bit luckier cause had he waited like
someone else stated,
it would've been worse...but he should still SUE HER!  Nasty women
that make
decent women look bad...makes me sick.

Damages are not good enough! Take the baby and give it up for adoption
in Chile, Australia, or Russia. Throw the bitch in jail for 100 years.

Send your former gf the bill for it. If she doesn't pay sue her in small
claims court.

You should have just ignored her at first. You can take the test within a
certain time if she accusses you of being the father.

But you should have done nothing and spent no money until it was necessary.

and have her show up 5 years later with a kid I don't know,  haven't
bonded with and is messed up how many ways? I'm not trying to preach,
but I took a risk, didn't use protection and that's not the kids
fault.  I totally agree the system is crap but I wouldn't have someone
else raise my kid, and I really thought it was mine.  I got played
though...
