I was married and got a divorce, at the time of the divorce, I shared a
lawyer with my husband, which he paid for and he was the one requesting the
divorce. He claimed that there was no property to be distributed as
equitable and claimed that it was already split up. He also claimed there
were no children from the marriage when there are 2 children who are minors.
We have a home together that was not distributed equitability. We owned the
home together; we later re-mortgaged it and have it in my name alone. Since
I am responsible for the whole mortgage, he claims he has 50% share it in.
We got divorced and when we re-mortgaged it later on while the marriage was
dissolved. He asked for 1% more of the home, he wanted 51% and I was to get
49%, He tricked me and made it so he gets 99% and I get 1%. The deed was
recorded like that. Now I am being sued in Supreme Court and he wants to buy
my 1% and it trying to take it from me. How can I retain my 1 % which should
be 49%, Its hard to beat in court because the agreement I signed that I did
not read states I own 1%. The judge asked if I wanted to have the property
sold. I don't know what to do. I've been given a week to supply an
application. What type of application should I supply? This divorce is a
fraud since my ex husband stated there was no property and there were no
children. Please help as I only have a week to prepare. Thanks

With all due respect, "Carl", no one can be this dumb.

I hope you catch something.

Besides the fact that she's using the name Carl, this all seems more
than a little unbelievable.

Like a clue?

Carl, did it ever occur to you that the answer may be to consult a
lawyer and a therapist?  I don't think that stirring the pot with a group
of NG geeks will get you where you want to go... Troll or no. =R=

In which case, you are as well qualified to advise your friend as
any of us armchair quarterbacks, but the answer is still to seek
the advice of an attorney to discuss her potential remedies, and
a therapist to figure out why she let this cad walk over her.  =R=
