It is only illegal to marry someone who is already married.

Engagement to someone who is in the process of divorce, no matter how
ill-advised that is, is not illegal.

I would have some serious questions for anyone who was in the divorce
process that attempted to make a commitment to another person before
getting their head screwed on straight - but that is just me.

There is, after all, no IQ requirement for getting engaged or married.
